1. Acceptance of Terms

Welcome to Cardvark Games (“Cardvark Games,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of cardvarkgames.com (the “Site”), including any content, functionality, and services offered on or through the Site, such as browsing our product and event information and submitting our Contact and Scheduling forms. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

2. About Cardvark Games

Cardvark Games is a trading card game and tabletop gaming shop located at 3637 Cortez Rd W #103, Bradenton, FL 34210, offering sealed and single Magic: The Gathering and Pokémon TCG products, gaming accessories, sanctioned and store-run tournaments, casual free play, and a private rentable gaming room (the “VIP Room”). The Site is provided to share information about our shop, products, and events, and to allow visitors to contact us and schedule events or reservations.

3. Eligibility & All-Ages Environment

Cardvark Games welcomes players of all ages and strives to maintain a comfortable, inclusive environment for our community. Because the Site’s Scheduling form may be used to register for events or reserve the VIP Room on behalf of a minor, any user submitting the form for a person under the age of 18 represents that they are the parent or legal guardian of that minor, or are otherwise authorized to register or make a reservation on the minor’s behalf, and accept responsibility for the minor’s conduct while on our premises.

Users under the age of 13 should not submit any personal information through the Site without the involvement of a parent or guardian. See our Privacy Policy, “Children’s Privacy,” for more information.

4. Products, Pricing & Availability

Product descriptions on the Site (including sealed product, singles, and accessories) are provided for general informational purposes only. All purchases, trades, and sales of trading cards and accessories take place in person at our Bradenton retail location; the Site does not currently process online sales or payments.
We make reasonable efforts to keep information about our products and offerings current, but trading card inventory, singles pricing, and secondary-market values change frequently and without notice. We do not guarantee that any specific card, sealed product, or accessory shown or referenced on the Site will be in stock or available at a stated price at the time of your visit.

5. Events, Tournaments & Free Play

Cardvark Games hosts a variety of sanctioned and store-run tournaments, leagues, and casual free play sessions. Event formats, schedules, entry fees (if any), and rules are subject to change at our discretion and, for sanctioned events, are also subject to the rules of the applicable tournament organizer (for example, Wizards of the Coast for Magic: The Gathering or The Pokémon Company International for the Pokémon TCG).

We reserve the right to limit attendance, close registration once an event reaches capacity, modify or cancel an event, or deny or revoke entry to any player for conduct that violates our Code of Conduct below.

6. VIP Room Reservations

Our private VIP Room is available to rent for tabletop gaming sessions (including Dungeons & Dragons) and includes seating, a dedicated table, and a mini-fridge. Reservations may be requested through the Scheduling form on the Site.

Submitting the Scheduling form is a request only; a reservation is not confirmed until you receive confirmation from Cardvark Games by phone or email.

Reservation length, pricing, deposit requirements, and cancellation windows will be communicated at the time of booking confirmation.
The renting party is responsible for the conduct of their group and for any damage to the VIP Room, table, mini-fridge, or other shop property beyond normal wear and use.

Cardvark Games reserves the right to decline a reservation request or to cancel a confirmed reservation, with notice, for reasons including scheduling conflicts, prior policy violations, or circumstances beyond our control.

7. Booking & Scheduling Form

When you submit the Scheduling form to register for an event or request the VIP Room, you agree to provide accurate, current, and complete information, including your first and last name, email address, and phone number, and (if applicable) any information about the minor you are registering. Providing false or misleading information may result in cancellation of a reservation or denial of entry.

8. Code of Conduct

Cardvark Games is committed to a welcoming, inclusive, and comfortable environment for players of all ages and backgrounds. While in our store, participating in an event, or communicating with us through the Site, you agree not to:
Harass, threaten, or discriminate against any other patron, player, or staff member;
Cheat, engage in unsportsmanlike conduct, or intentionally disrupt an event or other players’ free play;
Damage store property, including the VIP Room, gaming tables, or displayed merchandise; or
Engage in any unlawful activity on the premises or through the Site.

We reserve the right to refuse service, remove a patron from the premises, or bar a patron from future events for violation of this Code of Conduct, at our sole discretion.

9. Intellectual Property

The Site, including its text, graphics, logos, the Cardvark Games name and logo, layout, and design, is owned by Cardvark Games or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. Trading card game names, logos, and card imagery referenced on the Site (including Magic: The Gathering and Pokémon) are trademarks or copyrighted works of their respective owners and are referenced solely to describe the products and services we offer; no affiliation with or endorsement by those companies is implied.
You may view and print pages from the Site for your own personal, non-commercial use. You may not reproduce, republish, or distribute Site content for commercial purposes without our prior written permission.

10. Social Media & Community Channels

Links to our Facebook page and Discord community are provided on the Site for convenience. Your use of those platforms is governed by the respective platform’s own terms of service and privacy policy, not by these Terms. We are not responsible for content posted by other users on those platforms.

11. Third-Party Links & Services

The Site may link to third-party websites or services (such as Google Maps for directions, or social media platforms) that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site, and inclusion of a link does not imply our endorsement.

12. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information on the Site (including event schedules and product information) is complete, accurate, or current.

13. Limitation of Liability

To the fullest extent permitted by law, Cardvark Games and its owner, employees, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or relating to your use of the Site, your attendance at an event, or your use of the VIP Room, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site shall not exceed one hundred dollars ($100).

Nothing in these Terms limits any liability that cannot be limited under applicable Florida or federal law.

14. Indemnification

You agree to indemnify and hold harmless Cardvark Games and its owner and representatives from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your conduct at our store or an event.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Manatee County, Florida, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to our shop, events, or services. The “Effective Date” at the top of this document will be updated accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
